All individuals residing in Quebec at the time of the abuse who, while minors, suffered sexual abuse at the hands of members of the Canadian Province of the Congregation of Holy Cross, the former canonical province “The Canadian Province of the Holy Cross Fathers” (whose successor is the Piedmont Corporation) and the former canonical province “The Canadian Province of the Brothers of Holy Cross” (whose successor is the Jean-Brillant Corporation) for the period from 1940 until the final judgment in any educational institution, residence, summer camp, or any other place located in Quebec, as well as at Saint Joseph’s Oratory of Mount Royal.
With the exception of sexual abuse covered by the settlement in the case of Cornellier v. Canadian Province of the Congregation of Holy Cross (C.S.M. 500-06-000470-092), namely:
i. Those committed by a member of the Congregation of Holy Cross or a lay person against any individual while attending Collège Notre-Dame-du-Sacré-Cœur between September 1, 1950, and July 1, 2001;
ii. Those committed by a member of the Congregation of Holy Cross or a lay person against any natural person while they were attending Collège de St-Césaire between September 1, 1950, and July 1, 1991; and
iii. Those committed by a member of the Congregation of Holy Cross or a lay person against any natural person while they were attending Notre-Dame School in Pohénégamook between January 1, 1959, and December 31, 1964;
Also excluded from the group are persons who signed, on behalf of the Canadian Province of the Congregation of Holy Cross, the former canonical province “The Canadian Province of the Holy Cross Fathers,” Corporation Piedmont, the former canonical province “The Canadian Province of the Holy Cross Brothers,” Corporation Jean-Brillant and/or the Oratory of Saint Joseph of Mount Royal, a release for the same facts as those included in the definition of the group in this action, as well as persons who signed a release in favor of the Canadian Province of the Congregation of Holy Cross, the former canonical province “The Canadian Province of the Holy Cross Fathers,” Corporation Piedmont, the former canonical province “The Canadian Province of the Brothers of Holy Cross,” Corporation Jean-Brillant and/or the Oratory under the National Reconciliation Programs with the Orphans of Duplessis for the same facts as those included in the definition of the group in this action.
